Since Oct. 14, 2023, the temporary restrictions on rent indexation in Brussels, previously linked to the Energy Performance Certificate (EPC), have been lifted. Previously, from Oct. 14, 2022 to Oct. 13, 2023, specific rules applied depending on the property’s EPC category: <\/p>\n
After Oct. 13, 2023, properties with previously “bad” EPC scores can be fully indexed again. However, Brussels has introduced a new calculation method, which means owners cannot claim the lost indexing of the previous year. <\/p>\n

Rent indexation in Brussels is calculated on the basis of the base rent (excluding charges) and the health index.<\/p>\n

<\/strong><\/p>\n New rent = (Base rent x New index) \/ Base index<\/p>\n Example:<\/strong><\/p>\n Calculation: (\u20ac500 x 127.89) \/ 115.20 = \u20ac555.078125<\/p>\n The new monthly rent will then be \u20ac555.08, excluding charges.<\/p>\n <\/strong><\/p>\n Since Oct. 14, 2023, rent indexation for properties with an EPC E, F or G is again possible, but with a modified formula including a correction factor. This formula applies if: <\/p>\n The calculation then reads: New indexed rent = New indexed rent without restriction x Correction Factor.<\/p>\n Here the new indexed rent without restriction = (Base Rent x New Index) \/ Base Index.<\/p>\n <\/strong><\/p>\n <\/strong><\/p>\n Simplified correction factor = 0.5 x [(index 2022 + index 2023) \/ index 2023]<\/p>\n Here, “index 2022” is the health index of the month prior to the birthday in 2022, and “index 2023” is that of the month prior to the birthday in 2023.<\/p>\n If the rent for the current year has not yet been indexed, the correction factor must be applied as of Oct. 14, 2023. First calculate the indexed rent with the usual formula and then apply the correction factor. For retroactivity before Oct. 14, 2023, the old formula with 50% indexation applies. If the rent has already been indexed with 50% indexation, wait for the next contract expiration date. <\/p>\n Example with correction factor (EPC E):<\/strong><\/p>\n The owner can charge \u20ac565.98 per month as new rent.<\/p>\n Simplified correction factor = 0.5 x [(index 2021 + index 2022) \/ index 2022]<\/p>\n Here ‘index 2021’ is the health index of the month preceding the anniversary in 2021, and ‘index 2022’ is that of the month preceding the anniversary in 2022. The procedure for application is the same as above. <\/p>\n Correction factor = index 2022 \/ index 2023<\/p>\n Here, “index 2022” is the health index of the month prior to the birthday in 2022, and “index 2023” is that of the month prior to the birthday in 2023.<\/p>\n Correction factor = index 2021 \/ index 2022<\/p>\n Here, “index 2021” is the health index of the month prior to the birthday in 2021, and “index 2022” is that of the month prior to the birthday in 2022.<\/p>\n <\/strong><\/p>\n In Brussels, as in other regions, the rent can be indexed on each anniversary of the lease, i.e. a maximum of once a year from the first anniversary of the agreement. To index the rent, the landlord must comply with the legislation, which means that the lease must be registered and the tenant must have received an EPC certificate. <\/p>\n Tenants are not required to spontaneously index their rent, even if it is in the contract. It is the owner who must send the request to the tenant in writing, including the calculation, the new amount and the effective date. Since the new index is often published late in the month, it can be difficult for the tenant to rectify the situation in time. The landlord can then ask the tenant to pay the surcharge for that month. <\/p>\n <\/strong><\/p>\n If an owner forgets to index the rent, he can ask that it be corrected up to a maximum of three months back.
