ABOUT RENTAL SOFTWARE AND PLACEHOLDERS

When ending a lease in Belgium, correct and structured handling is crucial, both for the tenant and the landlord. The moment when the tenant hands over the keys marks the final stage of the lease. An essential part of this final stage is the place description upon departure. This document is of great importance, since in principle the property must be returned in the condition it was in when the lease began. The initial site description upon arrival serves as the only valid point of reference in this regard.

In modern property management, the days of paper checklists and blurred photos are over. Good leasing software transforms this often conflict-prone process into an objective, quick and legally watertight procedure.

THE FOUNDATION: LEGAL OBLIGATIONS AND FRAME OF REFERENCE

The place description at departure acts as an indispensable control mechanism to verify that the leased property was properly maintained during the rental period. The format of this exit document is usually identical to that of the place description at the start, which allows for an easy comparison of the property before and after the rental period.

The legal context: obligations by region

Housing regulations in Belgium fall under the jurisdiction of the regions, which means regulations can vary.

  • The Place Description at Commencement is always mandatory throughout Belgium for the owner of a leased property. This document is usually attached to the lease.
  • The Place of Departure description has differences. In the Brussels-Capital Region, it has been mandatory since 2018 to prepare and register this document. In Wallonia, on the other hand, there is no legal obligation.

Despite a lack of legal requirement in certain regions, professional landlords and property managers invariably choose to prepare an exiting place assessment. After all, the determinations determine the settlement and release of the rental deposit.

ESSENTIAL DATA AND THE TRAP OF MANUAL DOCUMENTATION

In order to ensure legal validity and avoid discussions, the place description at departure is required to include certain crucial information:

  • The date of formatting.
  • The full names and signatures of tenant and owner.
  • The new address of the departing tenant.
  • Relevant details of the lease (duration, type of property).
  • A detailed description of all parts of the house (floors, walls, faucets, etc.).
  • A summary of any damages identified.
  • Current meter readings (gas, water, electricity).

Manually preparing these documents on paper is error-prone, time-consuming and often leads to discussions. A paper document is rarely structured enough to objectively compare the condition of the property room by room and element by element with the situation years before. The solution lies in specialized software.

HOW GOOD RENTAL SOFTWARE HELPS WITH THIS

Professional leasing software, often offered as a mobile app or a total property management solution, is designed to radically simplify and professionalize the process of place description upon departure.

  1. Objective and Seamless Comparison (Commencement vs. Departure)

The greatest added value of software is the ability for direct, structured comparison. The software digitally stores the initial place description in a fixed structure. When the surveyor or landlord performs the inspection upon departure, the app automatically offers the data from the start as a reference. This makes it easy to objectively verify whether or not the tenant has caused damage. Working with the same template minimizes uncertainties and greatly reduces the potential for conflict.

  1. Waterproof Damage Documentation and Budget

A good place description on departure must be accurate and supported by evidence. Rental software facilitates this:

  • Integrated Photo and Video Recording: Through the app, every room and damage can be documented and photographed instantly, with the photos automatically linked to the right room and element (e.g., “scratch on parquet, living room”).
  • Structured Official Report: The software processes all text and photos into a clear, schematic and professional official report in PDF form, which can be sent directly to all parties (tenant and landlord).
  • Damage Estimate: Some specialized tools offer the ability to estimate the cost of any identified damage on the spot, which further speeds up the settlement of the deposit.
  1. The Distinction between Wear and Damage

A recurring point of contention is the interpretation of normal wear and tear versus damage due to negligent maintenance or abnormal use. Costs to repair normal wear and tear are the responsibility of the owner. Only damage due to inadequate maintenance or abnormal use is recoverable from the tenant. Rental software, often developed with input from real estate professionals, provides clear categories and objective description fields here that capture this distinction, strengthening the evidence base.

  1. Streamlined Handling of the Guarantee

The rental deposit, an escrow amount in the tenant’s name, serves to cover any damages and unpaid rent. Thanks to the rental software’s objective, digital reporting, the need for intervention by a justice of the peace in the event of a dispute is greatly reduced. Clarity in documentation ensures that the rental deposit can be released more quickly and based on concrete evidence in favor of the tenant (in the event of no damage) or distributed (in the event of damage).

PRACTICAL IMPLEMENTATION AND DISPUTE MANAGEMENT

The site plan should be prepared at the time the tenant finally hands over the keys to the property. Both the tenant and the owner are responsible for drafting, although the owner often engages a real estate firm or specialist to ensure neutrality and professionalism.

It is essential that the document be prepared as objectively as possible, in the presence of both parties.

  • No details on departure: If the property is returned in good condition, this will be noted in the place description, both parties will sign and the deposit will be released in favor of the tenant.
  • Established damage at departure: Damage must be recorded in detail in the place description, with appropriate photos as proof.

If the tenant does not agree with the contents of the site description, he should not sign it. In this case, a justice of the peace may intervene, who may appoint an independent expert to draw up the site description and estimate the cost of the necessary repairs. The rental deposit is then distributed based on the judgment of the justice of the peace. The use of professional rental software, however, significantly reduces the chances of ending up in the justice of the peace because the documentation is detailed and objective in advance.

In short, in today’s property management, the use of specialized leasing software is not an option, but a requirement. It provides the landlord with the necessary legal certainty and maximizes efficiency, while ensuring the transparency and objectivity needed to maintain a good relationship with the tenant.
